Terms of Service

These Terms govern your use of the MowGul platform, including booking lawn mowing services as a customer and operating your business as a provider.
1. Acceptance of Terms
By accessing or using the MowGul website, mobile applications, or related services (collectively, the "Platform"), you agree to these Terms of Service ("Terms") and our Privacy Policy. These Terms form a binding agreement between you and MowGul Inc ("MowGul," "we," "us," or "our").
If you do not agree, do not use the Platform. If you use the Platform on behalf of a business, you represent that you have authority to bind that business.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Platform.
Providers must complete onboarding, maintain accurate business information, connect a valid Stripe payout account, and comply with applicable licensing, insurance, and tax obligations for the services they perform.
3. Platform Role
MowGul is a technology marketplace that connects homeowners and property managers ("Customers") with independent lawn care businesses ("Providers"). MowGul facilitates quotes, scheduling, messaging, payments, and related tools but does not perform lawn care services.
Independent Providers
Providers are independent contractors, not employees, agents, or partners of MowGul. The service agreement for lawn work is between the Customer and the Provider. MowGul is not responsible for the manner or quality of on-site work except as expressly stated in these Terms.
Verified Providers:When we describe a Provider as "verified" on the Platform, we mean they have completed onboarding requirements such as business profile setup, service area configuration, pricing setup, payment payout readiness, and Platform review steps applicable at go-live. Verification does not guarantee future performance, insurance status, licensing in every jurisdiction, or suitability for every property.
4. Accounts
You may need an account to book services, manage visits, or operate as a Provider. You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials secure and notify us of unauthorized access
- Use only one account per person or authorized business representative unless we approve otherwise
5. Services Available on the Platform
The primary customer-facing service is professional lawn mowing, including optional add-ons such as edging where offered by a Provider. Available services, Providers, and markets may change over time and vary by ZIP code or service area.
6. Quotes, Booking & Service Requests
Quotes are generated from information you provide—such as address, lot size, grass height, terrain, and selected add-ons—together with each Provider's pricing rules. The price shown at checkout is the amount authorized or charged for that booking, subject to validation by our systems.
When you complete checkout, you submit a service request for the selected date and arrival window. The Provider may accept or decline the request. A booking is not confirmed for service until the Provider accepts (unless otherwise shown in the product at checkout).
You are responsible for accurate property information, including access instructions, gates, pets, obstacles, irrigation heads, and special conditions that affect pricing or safety.
7. Payments, Holds & Payouts
Payments are processed by Stripe and related payment partners. MowGul does not store full card numbers.
- Authorization at booking: For most one-time visits, your card is authorized when you complete checkout. Funds are held until the service workflow completes.
- Recurring plans: If you enroll in weekly or biweekly mowing, you authorize MowGul and Stripe to store your payment method and charge or authorize each scheduled visit according to your plan settings.
- Completion approval:After service, you may be asked to review completion in your portal. Provider payout is generally released after service completion and applicable review/dispute windows, minus MowGul's platform fee.
- Platform fee: MowGul charges Providers a platform fee on completed jobs (currently 10% unless otherwise disclosed in the Provider dashboard or a written promotion). Customers pay the quoted service price shown at checkout unless a valid refund or adjustment applies under these Terms.
- Taxes: You are responsible for applicable taxes unless we are required by law to collect and remit them.
8. Cancellations, Reschedules & Weather
Through the Platform, Customers may cancel or reschedule eligible visits before the service window begins.
- At least 24 hours before the arrival window: You may cancel or reschedule through your account for a full release/refund of held funds, subject to payment processor timing.
- Less than 24 hours before the arrival window: Self-service cancellation or reschedule is not available through the Platform. Contact support if exceptional circumstances apply.
- Weather or unsafe conditions: Providers may reschedule weather-impacted visits. Weather cancellations initiated by the Provider in good faith should not result in a customer penalty when processed through the Platform.
Providers may decline requests that do not fit their schedule, service area, or business rules. If a Provider declines or cancels before service, held funds should be released or refunded according to Platform payment rules.
9. Disputes, Refunds & Chargebacks
If there is a problem with a visit, contact the Provider through Platform messaging and/or MowGul support promptly. Customers may raise disputes through the Platform where available. Open disputes may delay provider payout while we review the matter.
MowGul may issue full or partial refunds or payment releases at its reasonable discretion, including for service failures, duplicate charges, or policy violations. You agree to attempt good-faith resolution through the Platform before initiating a chargeback for Platform-processed payments. Improper chargebacks may result in account suspension.
10. Customer Responsibilities
- Provide safe access to the service area
- Secure pets and remove toys, debris, or obstacles from the mowing area when possible
- Disclose sprinklers, hidden objects, steep slopes, or hazards
- Be available remotely through the Platform for status, messaging, and completion review
11. Provider Terms
In addition to these Terms, Providers agree to the following marketplace obligations:
- Maintain accurate service areas, pricing, availability, and capacity settings
- Respond to requests promptly and accept only jobs your crew can complete professionally
- Perform accepted services in a professional and lawful manner
- Upload truthful job information and photos where requested
- Maintain required insurance and business licenses for your operations
- Use Stripe Connect for payouts and keep payout information current
- Not solicit Platform Customers to book or pay off-platform for jobs introduced through MowGul
- Pay applicable platform fees on completed jobs processed through MowGul
MowGul may remove, suspend, or limit Provider accounts for policy violations, customer safety concerns, fraud, poor performance, or chargeback risk.
12. Reviews, Photos & User Content
Users may submit reviews, messages, photos, and other content ("User Content"). You grant MowGul a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and display User Content to operate, promote, and improve the Platform.
You represent that you have rights to content you upload and that it is accurate and lawful. We may remove content that violates these Terms or applicable law.
13. Prohibited Conduct
You may not:
- Use the Platform for unlawful, fraudulent, or abusive purposes
- Provide false property, identity, or payment information
- Interfere with Platform security or other users
- Scrape, copy, or reverse engineer the Platform except as allowed by law
- Harass Providers, Customers, or MowGul personnel
14. Electronic Communications
You consent to receive transactional communications by email, in-app notifications, and—if you opt in—SMS regarding bookings, account activity, and service updates. Message and data rates may apply to SMS.
15. Intellectual Property
The MowGul name, logos, software, and Platform content are owned by MowGul Inc or its licensors. You may not copy, modify, distribute, or create derivative works from Platform materials without our written permission.
16. Disclaimers
THE PLATFORM AND ALL SERVICES ARRANGED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. MOWGUL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
MowGul does not guarantee uninterrupted Platform access, specific response times from Providers, or particular lawn outcomes.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOWGUL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOWGUL'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO MOWGUL FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You agree to defend, indemnify, and hold harmless MowGul from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your User Content, your breach of these Terms, or—if you are a Provider—your on-site services, personnel, equipment, or failure to maintain required insurance or licenses.
19. Termination
You may stop using the Platform at any time. We may suspend or terminate access if you violate these Terms, create risk for users or MowGul, or as required by law. Sections that by their nature should survive termination will survive.
20. Governing Law & Venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. You agree that exclusive venue for disputes arising from these Terms or the Platform lies in the state or federal courts located in Virginia, and you consent to personal jurisdiction there.
21. Changes to These Terms
We may update these Terms from time to time. The Effective Date at the top shows when they were last revised. Material changes may be communicated by email, in-app notice, or Platform posting. Continued use after changes become effective constitutes acceptance, except where further consent is required by law.
